We provide the website subject to this Terms of Use agreement. Please read the document carefully. By accessing the Site and registering for its Services, you acknowledge these terms of use and agree to be legally bound by them. The agreement applies to current services as well as features and tools that shall be added in future. The agreement shall be binding on registered members as well as visitors browsing the site.

If you do not agree to any of the terms specified in this agreement, you should discontinue use of the Site and its Services.

1. Sign Ups and Registrations

Account Creation - To become a member, You must be at least 18 years of age with the authority to enter into a legally binding contract. If you are less than 18 years, use the site only under parental supervision.

Security - You will use a username and password to access your account. It is your responsibility to maintain the confidentiality of your username and password as well as the security of other personal information submitted by You. You will also be responsible for all activities and postings related to your account. We disclaim all responsibility for damages arising due to your inability to safeguard your account. If your account has been compromised, please notify Chat to a Potato at the earliest.

Termination - You can choose to terminate your account at any time by contacting us. Chat To A Potato also reserves the right to terminate your account if your conduct violates our Terms of Use or the applicable law.

2. User Conduct

1. You will use the website for lawful purposes only. Your use of the Site or its Services should not violate the laws of the country you live in or the country from which you browse the site.

2. Your activity should not affect the availability of the Site.

3. You should not disable the security measures in place by uploading or transmitting files that contain viruses, worms and Trojan horses.

4. You won’t post, upload or email junk mail or spam.

5. In sections that allow member postings, you shall not upload or post content, images and sounds that are unlawful, threatening, harassing,offensive, abusive,indecent, defamatory, slanderous, libellous, obscene or sexually explicit content against a fellow website user or a third party associate.

6. You warrant that you own the copyrights to all the content posted by you.

7. Your use of the site should not affect the reputation of our business or our third party associates.

8. Also, you agree not to employ spiders, robots and other automated technology to monitor the website activity or interact with it.

Failure to follow these terms will invite serious punishment including access denial, account termination and legal action.

You can write to us seeking permission to use any website content. We reserve the right to grant permission as well as revoke permission after it is granted.

The Site and the Service is provided on “as is” and “as available” basis without any warranty or representation expressed, implied or statutory to the extent permitted by the applicable law. We do not warrant that:

2. The Site will be available 24/ 7 and the Services uninterrupted and error-free

3. Defects will be rectified and repaired

4. Content is free of malware and viruses

5. Governing Law

These conditions are governed by and construed in accordance with the laws of Singapore, and the courts of Singapore shall have non-exclusive jurisdiction to determine any disputes, which may arise out of, under, or in connection with this Agreement.

We collect personally identifiable information from our members for our records. Your privacy is very important to us and hence we have special measures in place to ensure member information is collected and stored securely. You may be able to link to third party web sites via our site. We do not manage and control these sites. We also do not endorse them. Use content displayed there at your own risk. We will not be responsible for any losses or damages caused by delays, defects or omissions that exist in the information and services provided by third party sites. You should use these sites only after you review their respective policies.

8. Changes to the Policy

We as the owners of Chat to a Potato reserve the right to revise this agreement periodically. We may do so at our discretion and without prior notice. We will post a notification regarding the updated Terms of Use policy on the website. It is also your responsibility to review the Terms of Use periodically and take note of the changes. The changes come into effect immediately on posting. Continued use of the site after the changes have been made will be deemed that you have taken note of the changes and agree to be bound by them.

General Data Protection Regulation

1. Data protection principles

Chat to a Potato (CTAP) is committed to processing data in accordance with its responsibilities under the General Data Protection Regulation (GDPR).

Article 5 of the GDPR requires that personal data shall be:

  1. processed lawfully, fairly and in a transparent manner in relation to individuals;
  2. collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes; further processing for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes;
  3. adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
  4. accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay;
  5. kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed; personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organisational measures required by the GDPR in order to safeguard the rights and freedoms of individuals; and processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organisational measures.”

2. General provisions

  • This policy applies to all personal data processed by CTAP.

  • This policy shall be reviewed at least annually.

3. Lawful, fair and transparent processing

  • Individuals have the right to access their personal data and any such requests made to CTAP shall be dealt with in a timely manner.

4. Data minimisation

  • CTAP shall ensure that personal data are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.

5. Accuracy

  • CTAP shall take reasonable steps to ensure personal data is accurate.

  • Where necessary for the lawful basis on which data is processed, steps shall be put in place to ensure that personal data is kept up to date.

6. Security

  • CTAP shall ensure that personal data is stored securely using modern software that is kept-up-to-date. 
  • Access to personal data shall be limited to personnel who need access and appropriate security should be in place to avoid unauthorised sharing of information.
  • When personal data is deleted this should be done safely such that the data is irrecoverable.
  • Appropriate back-up and disaster recovery solutions shall be in place.

7. Breach

  • In the event of a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, personal data, CTAP shall promptly assess the risk to people’s rights and freedoms and if appropriate report this breach to the appropriate body.
